Ergogen Social is an AI-powered social media management platform that provides:

• Personality-based content generation
• AI-powered image generation for social media content
• Content ideation and brainstorming tools
• Trending topics discovery
• Content calendar and scheduling

3. User Accounts

3.1 Account Registration

You must create an account to use our Service. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Account Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent that you meet this age requirement.

4. AI-Generated Content

4.1 Content Ownership

You retain all rights to content you create using our AI tools. However, you acknowledge that:

• AI-generated content may not be entirely original and could be similar to content generated for other users
• AI model availability may change, and we may substitute equivalent models without notice
• You are responsible for reviewing and editing AI-generated content before publication
• We do not guarantee the accuracy, quality, or suitability of AI-generated content

4.2 Content Responsibility

You are solely responsible for all content you publish, including AI-generated content. You agree not to use our Service to create or distribute content that:

• Violates any laws or regulations
• Infringes on intellectual property rights of others
• Contains hate speech, harassment, or discriminatory content
• Is fraudulent, deceptive, or misleading
• Contains malware or harmful code

6. Subscriptions and Credits

6.1 Subscription Plans

We offer various subscription tiers (Free, Plus, Pro) with different features and credit allocations. Subscription fees are billed in advance on a recurring basis.

6.2 Credits

Credits are used for AI content generation and image generation. Credit costs vary based on quality level and model used. Credits:

• Do not expire while subscription is active
• Are non-transferable and cannot be converted to cash
• Can be purchased separately as needed

6.3 Payment

Payments are processed through Dodo Payments. You agree to pay all fees associated with your subscription and credit purchases.

7. Cancellation and Termination

7.1 Cancellation by User

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until then.

7.2 Termination by Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activities
• Your payment method fails repeatedly
• We discontinue the Service

8. Intellectual Property

The Service, including its software, features, and content (excluding user-generated content), is owned by Ergogen Social and protected by intellectual property laws. You may not:

• Copy, modify, or reverse engineer our Service
• Remove proprietary notices from our platform
• Use our branding without permission
• Create derivative works based on our Service

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. We comply with applicable data protection laws including GDPR and India's PDPA.

10. Disclaimers and Limitations of Liability

10.1 Service Availability

We provide the Service "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.

10.2 AI Limitations

AI-generated content may contain errors, inaccuracies, or inappropriate content. You must review all content before use. We are not responsible for content generated by third-party AI providers or their availability.

10.3 Third-Party Dependencies

Our Service relies on third-party APIs and services (Instagram, YouTube, LinkedIn, AI providers, payment processors). We do not guarantee their availability, functionality, or compliance with your needs. Service interruptions, rate limiting, or feature changes by third parties are beyond our control.

10.4 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless Ergogen Social from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your content or its publication
• Your violation of third-party rights

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, India.

14. Beta Features and Experimental Services

We may offer beta, experimental, or early-access features from time to time. These features:

• Are provided "as-is" without warranties of any kind
• May be discontinued, modified, or changed at any time without notice
• May have bugs, errors, or limited functionality
• May require additional testing and user feedback
• Do not guarantee future availability as production features

By using beta features, you acknowledge these limitations and agree that we may collect usage data and feedback to improve the Service.
